Privacy Notice

At James Avery, we value our customers' privacy and want you to be familiar with how we may collect, use and disclose your information in connection with our business. We have created this privacy notice so you are aware of such practices and your options related to information collected through our interactions with you, including through this website, our social media pages and emails, through our customer service, and at our retail store.

What Personally Identifying Information and Other Data We Collect

For each visitor to our website, we receive information concerning the usage of our website by that visitor, including the visitor's IP address, information concerning the visitor's browser and/or operating systems, and other access-related information. In addition, we (or a third party acting on our behalf) may use “cookies” or other tools in order to learn things like whether an email is opened, how a visitor uses our website, which pages are viewed and for how long, and whether a visitor returns to our website. See “Use of Cookies and Similar Tools” below for more information.

We also collect data that you personally enter into our website, and data that you provide to our sales associates in James Avery retail stores or our mail order customer service associates. We may collect this information in connection with inquiries, purchases, promotions, catalog orders, email correspondence, and online registrations. We may also receive other information about you generated as a result of our interactions with you, information from third parties (such as social media services or joint marketing partners) and information that you may directly provide to us through any phone, mail, fax, email, online interactions, sweepstakes or any paper registrations that you submit. The information that may be collected includes personal identifiers, such as your name, profile name, or social media user name; mailing address; email address; phone number; IP address; any personal preferences you choose to provide; transaction details such as style, size, price, date, store; and inferences drawn from any of the above. Information may also be collected when you interact with us on social media, such as when you “like” us or when you use one of our hashtags.

We use a third-party payment processor to handle all customer payment transactions. When you make a payment at checkout, any sensitive payment information you provide, such as your credit card number, will be collected only by the payment processor.

How We Use Information and How You Can Control Such Use

The information we collect is used to process orders, to bill and collect payment, to resolve problems or customer inquiries, to contact customers or prospective customers, to learn about our customers and personalize content, to meet legal concerns or obligations, and to maintain or improve our products and services, including our email or other marketing outreach, our website, and any other of our online or other business activities.

If you supply us with your mailing address, you may receive mailings from us with information on new products and services or upcoming events. If you do not wish to receive such mailings, you may be removed from our mailing list by requesting to be removed using any of the Contact/Opt-Out Methods listed below.

Within our website you have the option to join our email list and receive emails containing promotional information about our products, services, and offers. In addition, if you provide us with your email address on any of our other online pages or to our customer service or in-store associates, you may automatically be added to our email list and receive such emails. If you do not wish to receive our promotional emails, you may opt-out by clicking on the "unsubscribe" link found at the bottom of all promotional/advertising emails and following the related instructions, or by contacting us using any of the Contact/Opt-Out Methods listed below.

Persons who supply us with their telephone numbers will only receive telephone contact from us concerning purchases or direct inquiries made by such persons.

Further, upon your request via any of those methods, we will happily correct any inaccurate information concerning you that we may have in reasonably obtainable form.

We may provide personally identifiable or other information, without notice to you, in response to a lawful request from a law enforcement or government agency or in response to a formal request in a civil action that on its face meets the requirements for such a request. In addition, we may provide personally identifiable information, without notice, to credit bureaus or collection agencies if we are permitted or required to do so by law.

Information and Deletion Requests. In addition to disclosing what personal information we collect, how we use or share such information, and your options related to such use as provided above, your state's law may require that we notify you of rights you have as a resident of that state regarding your personal information. Subject to such applicable laws (including, but not limited to, the California Consumer Privacy Act for California residents), you may have the right to:

  • Request the deletion of your personal information that we have collected, subject to exceptions under applicable law (“Deletion Request”);
  • Opt-out of the “sale” of your personal information to third-parties (“Do-Not-Share/Sell Request”).
    NOTE: We are not data brokers and we do not sell your personal information to any third-parties in exchange for money. However, we nonetheless offer you the opportunity to opt-out of our sharing your information with marketing partners as described herein. Remember that you may also need to adjust your browser settings to limit or prevent information sharing/collecting via cookies located on our website or ads.

The Information, Deletion, and Do-Not-Share/Sell Requests mentioned above may be submitted via any “Contact/Opt-Out Methods” provided below. Only you, or your authorized agent or guardian (with sufficient verifiable proof), may submit a request related to your personal information. The submission must describe the specific request with sufficient detail that allows us to properly understand, evaluate, and respond to it. Recognizing the risk of potential abuse of these requests as an identity theft tool, we may ask for certain verifiable information to match against any of your information we may already have access to.
